There was a theory going around some time ago when the NSA wiretapping scandals were new and shiny that the reason the Admin didn't go to FISA is because they knew they wouldn't get approved.  Since FISA is pretty much a rubber stamp, having only denied about a dozen requests out of 10,000+ since it was created, this seemed odd.  The only reason that seemed plausible was that they were spying on the media, because we know the Bushies just LOVE freedom of the press.
